What information about you do we collect?

We will collect the following types of information from you or about you from a third party engaged in the delivery of your care:
  1. ‘Personal data’ meaning any information relating to an identifiable person who can be directly or indirectly identified from the data. This includes, but is not limited to name, date of birth, gender, full address, contact number, e-mail address, next of kin and NHS Number; and
  2. ‘Special category / sensitive data’ such as medical history including details of appointments and contact with you, medication, emergency appointments and admissions, clinical notes, treatments, results of investigations, supportive care arrangements, social care status, race, ethnic origin, genetics and sexual orientation.
Your healthcare records contain information about your health and any treatment or care you have received previously (e.g. from an acute hospital, GP surgery, community care provider, mental health care provider, walk-in centre, social services). These records maybe electronic, a paper record or a mixture of both. We use a combination of technologies and working practices to ensure that we keep your information secure and confidential.

 

Who do we receive information from?

Whilst we might share your information with the above organisations, we may also receive information from them to ensure that your medical records are kept up to date and so that our clinic and your doctor can provide the appropriate care.
In addition we may also receive data from the NHS regarding any care that you might be receiving from them.

 

Why do we collect this information?

We collect and hold your personal and sensitive data in order to proceed with the treatment that you expect.
To provide you with our services we will need to process your information in accordance with current data protection legislation.

 

How is the information collected?

The first point of collection will be the patient themselves, personal data are provided when the patient registers themselves at the clinic. Special category of data are collect by health professional (doctors and nurses) and only but not limited when this information is important to carry out the required treatment.
We also collect data from thirds part – when consented by the patient and to carry out the required treatment – such as GP surgeries, hospitals, private clinics and imagining centre.
Your information will be collected either electronically using secure transfer or encrypted network connection. This information will be retained in your electronic patient record.

 

How do we use this information?

We want to give you the best possible care and all personal and special data will be kept up to date and your records will be used to improve the care you receive.
We may also use this data that we hold to make improvements to our service and to communicate with you in regarding your health and well-being.
Information may also be used for clinical audit to monitor the quality of the service we provided.

  • GP surgeries and NHS Hospitals.
Your information will only be shared if it is appropriate for the provision of your care or required to satisfy our statutory function and legal obligations as your private care provider.

 

Legal Basis for Data Processing

Your information will only be processed if it is appropriate for the provision of direct care, to improve health care services offered or delivered and/or to meet our lawful function and legal obligations under the General Data Protection Regulations (GDPR) where data processing is necessary for:
Article 6(1)(d) – “…in order to protect the vital interests of the data subject or of another natural person;
Article 9(2)(h) – ‘… the purposes of preventative or occupational medicine for the assessment of the working capacity of the employee, medical diagnosis, the provision of health or social care treatment or the management of health or social care systems and services…’

 

How do we maintain the confidentiality of your records?

We are committed to protecting your privacy and will only use information that has been collected lawfully. Every member of staff who works for the clinic has a legal obligation to keep information about you confidential. We maintain our duty of confidentiality by conducting annual training and awareness, ensuring access to personal data is limited to the appropriate staff and information is only shared with organisations and individuals that have a legitimate and legal basis for access.
Information is not held for longer than is necessary.

 

Retaining Your Personal Data

Electronic patient records (EPRs) must not be destroyed, or deleted, for the foreseeable future.

 

Do I need to give my consent?

The GDPR sets a high standard for consent. Consent means offering people genuine choice and control over how their data is used. Consent is only one potential lawful basis for processing information. Therefore as your private provider we may not need to seek your explicit consent for every instance of processing and sharing your information, on the condition that the processing is carried out in accordance with this notice.
In the clinic, consent will be asked when:
  • Patient are self-requesting protected health information;
  • Patient needs to authorize the clinic to disclose health information to relatives;
  • Patient wants their health information to be sent by post/email;
Your consent will be documented within your electronic patient record.

 

What will happen if I withhold my consent or raise an objection?

You have the right to write to withdraw your consent to any time for any particular instance of processing, provided consent is the legal basis for the processing. Please contact your GP Practice for further information and to raise your objection.

 

Accessing Your Records

The Data Protection Act 1998 and General Data Protection Regulations allows you to find out what information is held about you including information held within your medical records, either in electronic or physical format. This is known as the “right of subject access”. If you would like to have access to all or part of your records, you can ask the receptionist and they will guide you through the process.

 

Your rights and your personal data

As we process your personal data, you have certain rights. These are a right of to be informed, the right of access, the right to rectification, the right to erasure, the right to restrict processing, the right to data portability, the right to object.
The Data Protection Act 1998 and General Data Protection Regulations allows you to find out what information is held about you including information held within your medical records, either in electronic or physical format. We will need to verify your identity so we may ask for a copy of your passport, driving license and/or recent utility bill.
If you believe any of the personal data we hold on you is inaccurate or incomplete such as your name or address or if any of your details are incorrect please inform us in order for this to be amended and so our records for you are accurate and up to date.

 

Mobile telephone number

If you provide us with your mobile phone number we may use this to send you reminders about your appointments or other health screening information. Please let us know if you do not wish to receive reminders on your mobile.
